Upkyo is the trade name under which a Limited Liability Company organized under the laws of the State of New Mexico, United States of America, operates the website upkyo.com and the Upkyo services. Content published on this website is the responsibility of Upkyo’s management. Any request about it can be sent to support@upkyo.com.
3. Infrastructure and data location
Our customers’ websites, databases and mailboxes are hosted on servers located in data centres in the European Union. We select our infrastructure partners for their security, redundancy and compliance, and we remain our customers’ single point of contact.
4. Applicable terms
Use of the website and services is governed by all documents in the Upkyo legal center, including the terms of service, the acceptable use policy, the privacy policy, the data processing agreement, the service level agreement, the billing policy, the refund policy and the domain registration agreement. In case of conflict, those documents prevail over this page.
5. Intellectual property and trademarks
Upkyo, its logo and all content specific to the website, including texts, interfaces and graphics, are the property of Upkyo and are protected by United States law and international intellectual property treaties. Any reproduction, modification or reuse without prior written permission is prohibited. Icons and illustrations from the Lagom theme are used under licence from RS Themes. Other trademarks mentioned, such as WordPress, Cloudflare and NordVPN, belong to their respective owners and are cited for information only.
6. Copyright and DMCA notices
We comply with the Digital Millennium Copyright Act. If you believe content hosted by Upkyo infringes your copyright, send a notice to support@upkyo.com stating: the copyrighted work concerned, the exact location of the infringing material, your contact details, a statement of good faith belief, a statement under penalty of perjury that the notice is accurate and that you are authorized to act, and your physical or electronic signature. We process every valid notice promptly and may remove the material or suspend the service concerned. The affected customer may send a counter-notice through the same channel. Accounts of repeat infringers are terminated.
7. Abuse reports
To report spam, phishing, malware or any unlawful use of a service hosted by Upkyo, write to support@upkyo.com with the address concerned and any useful evidence. Every report is reviewed and may lead to the immediate suspension of the service involved.
8. Personal data
How we process your data is described in our privacy policy. California residents have the rights provided by the California Consumer Privacy Act as amended by the CPRA: to know what data is collected, to request its deletion or correction, and to opt out of its sale or sharing. Upkyo does not sell your personal information. Individuals in the European Union have the rights provided by the GDPR. To exercise your rights, write to support@upkyo.com; we never discriminate against anyone for exercising them.

The website only uses cookies required for it to work: client area sign-in, form security and remembering your language. No advertising cookies are set. Details are in our privacy policy.

Information on this website is provided as is, for general information, and may change at any time. To the extent permitted by law, Upkyo shall not be liable for indirect damages arising from the use of the website. Service, uptime and liability commitments for customers are those set out in our terms of service.

12. Sanctions and export control
Upkyo services may not be used by persons in, or from countries subject to, United States economic sanctions, including those administered by OFAC, nor in violation of United States export control laws.

This page is governed by the laws of the State of New Mexico and the federal laws of the United States. Any dispute relating to the website falls under the competent courts of that State, without prejudice to mandatory rights consumers enjoy in their country of residence.
