The documents that govern our services
Each document covers a specific topic. Together, they make up your agreement with Upkyo. You will find them all in the menu.

1. Legal Notice
The Legal Notice identifies the operator of Upkyo, its registered address, and how to contact it. It also sets out the intellectual property rules that apply to upkyo.com.
2. Terms of Service
The Terms of Service are the core agreement that applies to all Upkyo services. They set out each party’s rights and obligations, liability, suspension and termination, and how disputes are resolved through arbitration. The other documents build on them.
3. Acceptable Use Policy
The Acceptable Use Policy explains what is not allowed on our services, including unlawful content, spam, malware, attacks, and abusive use. It also describes the actions we may take if the policy is violated.
4. Privacy Policy
The Privacy Policy explains what personal data we collect, why, how long we keep it, and who we share it with. It describes your rights under the GDPR and U.S. privacy laws, and how to exercise them.
5. Cookie Policy
The Cookie Policy details the cookies and similar technologies used on our websites and in the client area, and how to manage your preferences.
6. Data Processing Agreement
The Data Processing Agreement governs the personal data we process on your behalf when you host websites, email, or files with Upkyo. It sets out our commitments as a processor, our categories of subprocessors, and how we notify you of data breaches.
7. Service Level Agreement
The Service Level Agreement describes our 99.99% uptime target, how uptime is measured, the exclusions, any service credits available if we fall short, and how to request them.
8. Billing and Renewal Policy
The Billing and Renewal Policy explains how we bill for our services, which payment methods we accept, how taxes apply, and how automatic renewal works at the end of each term. It also explains how to cancel a service from your client area and what happens if a payment is missed.
9. Refund and Cancellation Policy
The Refund and Cancellation Policy sets out the 30-day money-back guarantee on hosting, the services it excludes, and how to request a refund. It also covers the right of withdrawal available to consumers in the European Union.
10. Domain Name Policy
The Domain Name Policy sets the terms for registering, renewing, and transferring domain names through our ICANN-accredited registrar partner. It incorporates ICANN rules, the UDRP, and the rules of each registry.
11. Backup and Retention Policy
The Backup and Retention Policy describes the automatic hourly backups included with hosting, how long they are kept, and how restores work. It makes clear that these backups are a convenience and that you remain responsible for your own copies.
12. Fair Use Policy
The Fair Use Policy explains how any resources described as unlimited or unmetered apply in practice and what we consider normal use. It describes the steps we may take when a service uses resources at the expense of other customers.
13. Copyright Policy
The Copyright Policy explains how to notify us of infringing content under the Digital Millennium Copyright Act, how to submit a counter-notice, and how we handle repeat infringers.
14. Abuse Reporting Policy
The Abuse Reporting Policy explains how to report spam, phishing, malware, or any other unlawful use of a service hosted with Upkyo, what information to include, and how we handle each report.
15. Law Enforcement Requests
The Law Enforcement Requests policy describes how we handle requests for data or content removal from government and judicial authorities: the formal requirements, how we review their validity, and, where the law allows, how we notify the affected customer.
16. Security and Disclosure Policy
The Security and Responsible Disclosure Policy describes the safeguards that protect our services and how security responsibilities are shared with our customers. It also explains how to report a vulnerability and offers protection to researchers acting in good faith.
17. Affiliate Program Terms
The Affiliate Program Terms apply to anyone who recommends Upkyo in exchange for a commission. They cover approval, referral tracking, how commissions are calculated and paid, and prohibited promotional practices.
18. Accessibility Statement
The Accessibility Statement sets out our goal of conformance with WCAG 2.1 Level AA, the measures in place, and the known limitations of our services. It also explains how to get help or request content in another format.
19. Order of Precedence and Controlling Language
If documents conflict, the following order of precedence applies: special terms accepted in writing for an order or a quote; then the document specific to the service or topic, such as the Domain Name Policy, the Data Processing Agreement, or the Affiliate Program Terms; then the Terms of Service; and finally the other policies. Mandatory provisions of applicable law, including those that protect consumers in the European Union, prevail in all cases.
Our documents are published in several languages. If translations differ, the English version controls. The applicable version is the one published on upkyo.com on the relevant date; material changes are announced by email or in the client area.
